The services/ products availed from this portal by feeding input data are not guaranteed for any desired outputs as the output depends on the input data by you as well as the formulas and assumptions applied in the software by the Entity, and hence M/s. FortRisk Consulting is not liable for any complaint/dissatisfaction on the output derived from the software tools in the portal/website. There is no provision to refund the cash remitted/ transferred for the services, as it is the only responsibility of the customers to ensure the desirability of the service/output before the payment.
7. Disclaimer of Warranty
THESE SERVICES ARE PROVIDED BY THE ENTITY ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE ENTITY MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF ITS SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN. WITHOUT LIMITING THE FOREGOING, NEITHER US NOR ANYONE ASSOCIATED WITH US REPRESENTS OR WARRANTS THAT THE SERVICES, THE CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

8. Limitation of Liability

Except as prohibited by law, if there is liability found on the part of the entity, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages.
9. Site policies, modification, and severability

We reserve the right to make changes to our site, policies, and these Terms and Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
10. Jurisdiction, venue, and governing law
Through your use of the website, software, or services, you agree that the laws of India shall govern any matter of dispute arising between you and the Entity. Any dispute relating in any way to your visit to www.fortriskconsulting.com for availing services from it shall be submitted to confidential arbitration in Mumbai, India, except that, to the extent you have in any manner violated or threatened to violate M/s. Fortrisk Consulting/ www.fortriskconsulting.com‘s intellectual property rights, the Entity may seek injunctive or other appropriate relief in any state or federal court in the city of Mumbai, India, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the Government of Maharashtra/India. The arbitrators’ award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

BY USING THE PRODUCTS OR SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
